These Website Terms (“Terms”) govern access to and use of finqpulse.com (the “Website”), operated by FinQ Technologies and Consulting, a company registered in the Republic of Armenia (“FinQ”, “we”, “us” or “our”). By using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. Purpose of the Website

The Website provides general information about FinQ, FinQ Pulse, demonstrations, pilots, subscription options and professional services. It is intended primarily for financial institutions, their employees, professional advisers and other business users.

2. No product contract or binding offer

Website content, plan descriptions, proposed service levels, timelines and commercial terms are informational and do not constitute a binding offer. Access to FinQ Pulse, a pilot, implementation, support, consulting or other services requires a separate written agreement signed or otherwise validly accepted by FinQ and the customer. If these Terms conflict with an executed customer agreement, the executed customer agreement controls for the relevant service.

3. No professional, regulatory or investment advice

Website content is not legal, regulatory, accounting, audit, investment, model-validation or risk-management advice and should not be relied on as a substitute for professional judgment. Financial institutions remain responsible for their methodologies, assumptions, controls, approvals, regulatory obligations and decisions.

4. Permitted use

You may access and use the Website for lawful internal business evaluation. You may not attempt to gain unauthorized access to the Website or related systems; interfere with security or availability; introduce malicious code; scrape the Website at an unreasonable rate; misrepresent your identity; use content to create a misleading endorsement; or copy, modify, distribute or commercially exploit Website content except as permitted by law or with FinQ’s written consent.

5. Intellectual property

The Website; the names and branding of FinQ Technologies and Consulting and FinQ Pulse; and the Website’s text, graphics, layouts, software descriptions and other content are owned by or licensed to FinQ Technologies and Consulting and are protected by applicable intellectual-property laws. No right, title or license is granted except the limited right to use the Website in accordance with these Terms.

6. Requests, communications and confidentiality

You are responsible for the accuracy of information submitted through the Website. Do not transmit confidential banking datasets, customer records or sensitive personal data through the public contact form. Information will not be treated as confidential unless FinQ has separately agreed in writing to confidentiality obligations.

7. Third-party services and links

The Website may link to third-party websites or services, including app.finqpulse.com. Third-party services are governed by their own terms and policies. A link does not imply endorsement, and FinQ is not responsible for third-party content, availability or practices.

8. Website availability and changes

We may update, suspend or discontinue any part of the Website without notice. We do not guarantee that the Website will always be available, uninterrupted, secure or error-free. Product descriptions may change as FinQ Pulse develops, and only the scope stated in an executed agreement is binding.

9. Disclaimers

To the maximum extent permitted by applicable law, the Website and its content are provided “as is” and “as available”, without express or implied warranties, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement or availability. Nothing in these Terms excludes a warranty or obligation that cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by applicable law, FinQ Technologies and Consulting and its personnel will not be liable for indirect, incidental, special, consequential or punitive loss, loss of profit, loss of opportunity, business interruption, loss of data or decisions made in reliance on Website content. FinQ does not limit liability where limitation is prohibited by law, including liability arising from fraud or intentional misconduct.

11. Privacy

Our processing of personal data through the Website is described in the Privacy Policy.

12. Governing law and jurisdiction

These Terms and any non-contractual dispute arising from the Website are governed by the laws of the Republic of Armenia, without regard to conflict-of-law principles. Unless mandatory law requires otherwise, disputes are subject to the jurisdiction of the competent courts of the Republic of Armenia.

13. General provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign rights under these Terms without our written consent. We may update these Terms by publishing a revised version on the Website; continued use after the effective date constitutes acceptance of the revised Terms.
